Welcome to Templatesforest.com, a website and online service (collectively the “Service” or “Templates Forest”) of Templates Forest Labs, Inc. and/or any of its affiliates (“CM,” “we,” “us,” or “our”). This page explains the terms by which you may use our online and/or website, and in connection with the Service. By using the website, creating an account and checking the “I agree” (or similar) box, or otherwise accessing or using the Service, you (1) agree that you have read, understood, and agree to be bound by the terms and conditions of these Terms of Service, including the License Terms and Font License Terms (collectively, the “License”), which constitute a binding agreement with us, and (2) also that you have read and acknowledge the collection and use of your information as set forth in our privacy policy (the “Privacy Policy”), whether or not you are a registered user of the Service. These Terms apply to all visitors, users, buyers, sellers and others who access the Service (“User(s),” or “you,” or “your”). If you open a Templates Forest account on behalf of an organization or other entity, then (i) “you” includes you and that entity, and (ii) you represent and warrant that you are an authorized representative of the entity with the authority to bind the entity to these Terms, and that you agree to these Terms on the entity’s behalf.
PLEASE READ THIS AGREEMENT CAREFULLY AND BE SURE YOU UNDERSTAND IT FULLY, BECAUSE IT EXPLAINS AND CONTROLS YOUR LEGAL RELATIONSHIP WITH US AND YOUR RIGHTS RELATED TO YOUR USE OF THE SERVICE.
PLEASE NOTE: SECTION 19 CONTAINS A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER. IT AFFECTS YOUR RIGHTS ABOUT HOW TO RESOLVE ANY DISPUTE WITH US. PLEASE READ IT CAREFULLY.

1. Use of Our Service.
Template Forest provides a creative community and marketplace where Users can buy design items, such as Unbounce landing page, WordPress websites, Photoshop Designs, and other digital assets (“Assets”) and socialize around the content (e.g. make comments and participate in Discussions). Our Service allows for a buyer (“Buyer”) to purchase limited licenses (in accordance with the applicable license agreement) to use Assets from shops opened on template Forest by independent creators (“Shop Owners”). References to “buying” or “purchasing” Assets means buying or purchasing limited licenses to those Assets.
Eligibility. You may use the Service only if you can form a binding contract with Template Forest, and only in compliance with these Terms and all applicable local, state, national, and international laws, rules and regulations. Any use or access to the Service by anyone under 13 is strictly prohibited and in violation of these Terms. The Service is not available to any Users previously removed from the Service by template Forest.
License Terms. Your use of any Assets is subject to the applicable License (outlined in General Licenses and Font Licenses.) We offer different license types, so it is important that you carefully review the rights and restrictions of the License that applies to the Assets before you purchase a license. In the event of a conflict between the License applicable to you and these Terms, the License will apply to the extent of that conflict.
Template Forest Service. Subject to the terms and conditions of these Terms, you are hereby granted a non-exclusive, limited, non-transferable, freely revocable license to use the Service for your use only as permitted by the features of the Service and by these Terms. Template Forest reserves all rights not expressly granted herein in the Service and the Template Forest Content (as defined below). Template Forest may terminate this license at any time for any reason or no reason.
Template Forest Accounts. Your Template Forest account gives you access to the services and features that we may establish, maintain, and modify, from time to time and in our sole discretion. We may maintain different types of accounts for different types of Users. By connecting to Template Forest with a third-party service, you give us permission to access and use your information from that service as permitted by that service, and to store your login credentials for that service. You are responsible for tracking all activity on your own account, and you agree to the following:
- To store all passwords and usernames securely.
- To notify Template Forest of any unauthorized use or security breach. Template Forest will not be liable for any liability, damage, cost, loss or expense caused by or in connection with any unauthorized use of your account.
- To never share login details or account access with clients or team members.
- To accept responsibility for activity that occurs under your account(s).
- To never transfer or “sell” your account to another person
Monitoring and Enforcement; Termination. Template Forest reserves the right to monitor downloads and user activity to ensure compliance with the terms of these Terms and the applicable License, which it may update from time to time. We may, without notice, change the Service, stop providing the Service or features of the Service, or create usage limits for the Service. We may permanently or temporarily terminate or suspend your access to the Service without notice or liability for any reason, including if in our sole determination you violate any provision of these Terms, or for no reason. We may remove or refuse to post any User Content (defined below) for any reason or no reason in our sole discretion. Upon termination for any reason or no reason, you continue to be bound by these Terms.a
2. Notifications and Emails
3. Service Rules. You agree not to engage in any of the following prohibited activities:
- Copying, distributing, or disclosing any part of the Service in any medium, including without limitation by any automated or non-automated “scraping”.
- Using any automated system, including without limitation “robots,” “spiders,” “offline readers,” etc., to access the Service in a manner that sends more request messages to the Template Forest servers than a human can reasonably produce in the same period of time by using a conventional online web browser (except that Template Forest grants the operators of public search engines revocable permission to use spiders to copy materials from TemplateForest.com for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials).
- Transmitting spam, chain letters, or other unsolicited promotional email.
- Attempting to interfere with, compromise the system integrity or security or decipher any transmissions to or from the servers running the Service.
- Taking any action that imposes- or may impose, as we determine at our sole discretion- an unreasonable or disproportionately large load on our infrastructure.
- Uploading invalid data, viruses, worms, or other software agents through the Service, including through any User Content.
- Collecting or harvesting any personally identifiable information, including account names and emails, from the Service.
- Using the Service for any commercial solicitation purposes.
- Impersonating another person or otherwise misrepresenting your affiliation with a person or entity, engaging in fraud, hiding or attempting to hide your identity.
- Interfering with the proper working of the Service.
- Accessing any content on the Service through any technology or means other than those provided or authorized by the Service.
- Bypassing the measures we may use to prevent or restrict access to the Service, including without limitation features that prevent or restrict use or copying of any content or enforce limitations on use of the Service or the content.
- We may, without notice, change the Service, stop providing the Service or features of the Service, or create usage limits for the Service. We may permanently or temporarily terminate or suspend your access to the Service without notice or liability for any reason, including if in our sole determination you violate any provision of these Terms, or for no reason. Upon termination for any reason or no reason, you continue to be bound by these Terms.
4. Resolution Process for Transactions.
All parties share the responsibility for making sure that purchases facilitated by our Service are satisfactory and hassle-free. Our Service hosts the resolution process for transactions when Buyers claim that their Asset was not received, or the Asset they received was different from what was described in the product listing. We may take a more active role in ensuring transaction problems are resolved; however, you understand that we are not obligated to do so. You agree to permit us to make a final decision, in our sole discretion, on any disputes. We reserve the right to fix any processing errors we discover. We will correct any processing errors by debiting or crediting the payment method used. Should you file a chargeback or dispute on a purchase you have made on Template Forest, we reserve the right to close your account without notice (in compliance with applicable laws and rules). Purchases are subject to the following Chargeback Policy, which may change from time to time.
5. Our Proprietary Rights.
Except for your User Content, the Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and User Content belonging to Template Forest, other Users, and other licensors to Template Forest (the “Template Forest Content”), and all Intellectual Property Rights related thereto, as between you and Template Forest, are the exclusive property of Template Forest and its licensors (including that of other Users who post User Content to the Service). Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works from any Template Forest Content. Use of the Template Forest Content for any purpose not expressly permitted by these Terms is strictly prohibited. You may choose to or we may invite you to submit comments or ideas about the Service, including without limitation about how to improve the Service or our products (“Ideas”). By submitting any Idea, you agree that your disclosure is gratuitous, unsolicited and without restriction and will not place Template Forest under any fiduciary or other obligation, and that we are free to use the Idea without any additional compensation to you, and/or to disclose the Idea on a non-confidential basis or otherwise to anyone. You further acknowledge that, by acceptance of your submission, Template Forest does not waive any rights to use similar or related ideas previously known to Template Forest, or developed by its employees, or obtained from sources other than you.
6. Template Forest Property.
Certain aspects of thae Service may allow you to obtain certain reputational or status indicators and/or purchase Service currency (“Credits” used to easily buy Assets (collectively “Template Forest Property”). While the Credits you purchase do not expire, you acknowledge and agree that if your account becomes Inactive, Template Forest may, without further notice to you, redeem all Credits remaining in your account for any other Template Forest Property that Template Forest selects, in its sole discretion. If your account is terminated or you cancel your account, you will not receive any refund or credits, except as described below in Section 8 pursuant to our Refund & Exchange Policy. For purposes of this Section 7, the term “Inactive” means that, based on Template Forest’s records: (i) for a period of one (1) year, or more, you have not logged into your account on the Service; or (ii) despite commercially reasonable efforts, Template Forest has been unable to contact you to verify that you intend to continue use of your account. You understand and agree that regardless of terminology used, Template Forest Property represents a limited license right governed solely by the terms of these Terms and available for distribution at Template Forest’s sole discretion. Template Forest Property is not redeemable for any sum of money or monetary value from Template Forest at any time. You acknowledge that you do not own the account you use to access the Service, nor do you possess any rights of access or rights to data stored by or on behalf of Template Forest on Template Forest servers, including without limitation any data representing or embodying any or all of your Template Forest Property. You agree that Template Forest has the absolute right to manage, regulate, control, modify and/or eliminate Template Forest Property as it sees fit in its sole discretion, in any general or specific case, and that Template Forest will have no liability to you based on its exercise of such right. All data on Template Forest’s servers are subject to deletion, alteration or transfer. Notwithstanding any value attributed to such data by you or any third party, you understand and agree that any data, account history and account content residing on Template Forest’s servers, may be deleted, altered, moved or transferred at any time for any reason in Template Forest’s sole discretion, with or without notice and with no liability of any kind. Template Forest does not provide or guarantee, and expressly disclaims, any value, cash or otherwise, attributed to any data residing on Template Forest’s servers6
7. Payment Information and Taxes.
All information that you provide in connection with a purchase or transaction or other monetary transaction interaction with the Service must be accurate, complete, and current. You agree to pay all charges incurred by users of your credit card, debit card, or other payment method used in connection with a purchase or transaction or other monetary transaction interaction with the Service at the prices in effect when such charges are incurred. You will pay any applicable taxes, if any, relating to any such purchases, transactions or other monetary transaction interactions.
8. Privacy.

You understand that by using the Services you consent to the collection, use and disclosure of your personal information as set forth in our Privacy Policy, and to have your personal information collected, used, transferred to and processed in the United States.
9. Security
Template Forest cares about the integrity and security of your personal information. However, we cannot guarantee that unauthorized third parties will never be able to defeat our security measures or use your personal information for improper purposes. You acknowledge that you provide your User Content and personal information at your own risk. You are fully responsible for all interaction with the Service that occurs in connection with your registration information (including, without limitation, all purchases). You agree to immediately notify us of any unauthorized use of your registration information or any other breach of security related to your account or the Service, and to ensure that you “log off”/exit from your account with the Service (if applicable) at the end of each session. Please see Section 1 (“Use of our Service”) for requirements on managing Template Forest accounts. We are not liable for any loss or damage arising from your failure to comply with any of the foregoing obligations. If you sign into the Service using a third-party social networking platform account, be sure to review the privacy and data usage policies of such platform to learn more about its personal information practices and your options, as they may differ from those governed by our Privacy Policy and these Terms.
